Resolving challenges for resource mining enterprises

(News Portal – Dong Nai) - On March 28th, Vice Chairman of the Provincial People's Committee, Vo Van Phi, held a working session to address the challenges faced by mining enterprises operating in Bien Hoa City.

In his concluding remarks, Vice Chairman Vo Van Phi stated that representatives from the 7 stone mining sites, including Tan Cang 2, Tan Cang 3, Tan Cang 4, Tan Cang 7 and 9, Ap Mieu, and Tan Cang 8, had highlighted three major obstacles: land leasing, investment certification adjustments, and the auction of mining rights.

Regarding land leasing, during the process of assessing the land usage needs of businesses, there were differing opinions among provincial departments and agencies. Previous mining permits did not include provisions for auxiliary and processing areas. The majority of investment certificates had expired, and while businesses applied for renewal, they encountered complications due to overlapping land use and construction planning. As for the auction of mining rights, projects seeking expansion were temporarily suspended pending the determination of the auction area for mining rights.

Consequently, the enterprises requested the Provincial People's Committee, as well as the departments, committees, and agencies, to assist in streamlining the legal procedures for land leasing contracts, adjusting investment certificates, and expediting the organization of mining rights auction.

According to the provincial departments and agencies, the aforementioned challenges arose from the lack of synchronization between the Land Law and the Mineral Law, as well as numerous regulatory changes. The adjustment of land usage planning and construction planning also contributed to the complications. Additionally, businesses engaging in self-compensation and land transfers with individuals have resulted in incomplete legal procedures for land leasing.

In conclusion of the working session, Vice Chairman Vo Van Phi assigned the Department of Construction, in collaboration with the Department of Planning and Investment, the Department of Natural Resources and Environment, the People's Committee of Bien Hoa City, and the enterprises, to coordinate and advise the Provincial People's Committee on resolving issues related to planning, investment certification adjustments, land leasing, and more. This should be done in a collective spirit, in accordance with regulations, and based on the practical challenges faced by the enterprises. The Provincial Land Registration Office will provide guidance on land usage registration.
